REGISTRATION OF CONTRACTORS, VENDORS, CONSULTANTS AND SERVICE PROVIDERS BY GOVERNMENT OF EKITI STATE

REGISTRATION OF CONTRACTORS, VENDORS, CONSULTANTS AND SERVICE PROVIDERS


(1.0)  INTRODUCTION


Pursuant to Sections 6(Ih), 6(2c), 12(2) and 13(1) of Ekiti State Public Procurement Re-Enactment Law No. 4 of 2020 (EKSPPRL-2020) and in light of recently assented Companies and Allied Matters Act 2020 (CAMA-2020), the Bureau wishes to announce the following guidelines for registration of entities (contractors, consultants, vendors and service providers). In essence, interested and reputable companies and organisations in the contract, consultancy, supplies, service provision industries, with relevant experience are invited to submit application for registration to deliver contracts or provide professional or non-professional services in any of the sectors listed in paragraph 2 below.


It should be noted that the information data supplied by successfully registered entities shall form their respective dossier to be entered into a centralised database maintained for the Government of Ekiti State by the State’s Bureau of Public Procurement.


(2.0)  AREAS OF CONTRACTS AND SERVICES


The required works, goods and services will include but not be limited to the following listed area(s):


(a)     Works


(i)      Construction and Civil Works (roads, building, channeling and drainage, renovation, rehabilitation, reconstruction, erosion control, etc.);


(ii)     Water, Mechanical and Electrical Engineering Works (plumbing, reticulation, generator, mechanical and electrical installations and fittings, maintenance works, installation of plants and equipment, etc.);


(iii)    Document printing, production and reproduction


(iv)    Furnishing or retro-fitting of public buildings (laboratory works, installation of equipment/appliances, removal of unwanted equipment/appliances, etc.)


(v)     Urban development and renewal (horticulture, walkways, road redesign, layout planning, etc.)


(vi)    Agriculture and Farm development (land clearing, rome ploughing, irrigation and water reticulation, crop and tree planting, grassing, construction of farm roads, etc.)


(vii)   Production and installation of information and communications technologies and equipment (including software and hardware)


(viii)  Installation and/or operation of fire equipment, mechanical or electrical plant, electrical installations, urban development features, public utilities, etc.


(b)     Supplies


(i)      Mechanical Equipment and Appliances (Tractors, Vehicles, Motorised equipment, agriculture machinery, iron and steel materials, plant equipment, etc.);


(ii)     Electrical Equipment and Appliances (transformer, electrical cables, solar appliances, electrical devices, etc.);


(iii)    Civil materials (cement, sand, gravel or aggregates, etc.)


(iv)    Office support machine (desktop computers, laptop computers, printers, photocopiers. UPS, etc.);


(v)     Office Supplies and accoutrements (furniture, fittings and fixtures, printing papers, TV sets, refrigerators, air condition units, staplers, etc.)


(vi)    Educational or instructional materials (uniforms, books, furniture, laboratory equipment and materials, reagents, book publication, production of instruction materials, book purchase);


(vii)   Agricultural and Farming inputs (seedlings, stalks, fertilisers, grains, etc.)


(viii)  Food supplies


(ix)    ICT equipment and machinery (phones, computers, digital devices, etc.)


(x)     Emergency and/or relief materials (howsoever described)


(c)      Consultancy and Non-Consultancy Services


(i)      Architecture and Building Construction Consultants; Civil, Roads, Highway and Transportation Engineering Consultancy Services etc.;


(ii)     Water Engineering, Mechanical and Electrical Engineering Consultancy Services etc.;


(iii)    Consultancy on Rural Electrification Projects;


(iv)    Computer and Information/Communication Technology Equipment and Infrastructure Consultancy, etc.;


(v)     Legal Consultancy Services;


(vi)    Advisory Services;


(vii    Human Capital Development Consultancy;


(viii)  IT and digital related consultancies (mobile app development, data science, digital marketing, social media management, UX design, video production and editing, animation, etc.);


(ix)    Finance and Financial Services (Revenue and Tax Consultancy, Banks and other Financial Institutions, Stocks Brokerage Firms, Investment Advisers. Funds Management, Assets Management, Accounting, Auditing Firms, etc.);


(x)     Plant and facilities management and maintenance;


(xi)    Assets evaluation and disposal services, including auctioneering;


(xii)   Insurance Services (Insurance Companies and Brokerage Firms);


(xiii)  Hospitality and Entertainment (Hotels and Hoteliers, Events Planning and Management, Tourism Practitioners, Ticketing and Travel Agents, etc.)


(3.0)  DOCUMENTATION/REQUIREMENTS


Prospective entities, firms, service providers and/or vendors are required to submit the following documents along their applications:


(a)  Evidence of registration of company or business name with the Corporate Affairs Commission (Certificate of incorporation for Limited Liability Companies or Registration of Business Name for Enterprises);


(b)  Memorandum and articles of Association (MOA and AOA), Form CAC-07 i.e. Particulars of Directors and Form CAC-02 i.e. Particulars of Shareholders;


(c)   Copy of Company’s Income Tax Clearance Certificate;


(d)   Copy of Personal Income Tax Clearance Certificate (of at least 2nos. Directors, in the case of Limited Liability Companies (LLC) or at least 1 no. Proprietor/Partner in case of Enterprise) covering the last three (3) years;


(e)    Value Added Tax (VAT) Registration Certificate and evidence of past remittances;


(f)     Company’s/Enterprise’s detailed profile (to contain full names and contact addressees of directors and business address to include functional telephone and Email); List and resume of Management and key professional staff with photocopies of their academic qualifications, proficiencies and/or professional affiliations, certificate and evidence of registration with relevant accredited professional body(ies);


(g)     List and verifiable documentary evidence of project(s) successfully executed/completed/delivered in relevant sectors in the last five (5) years (submission of the following documents would confer additional advantages i.e. copies of letter of engagement for services or commissioning. Partnership or Joint Venture Agreement or Memorandum of Understanding (MoU) with specialised Foreign Consultancy firms or institutions would be advantageous);


(h)     List of owned equipment or technology available for deployment on assignment (with photo evidence and photocopy of receipt of purchase)


(i)      Evidence of financial capability (reference letter issued by a reputable bank) is mandatory;


(j)      Name(s) and Contact Address(es) with e-mail/telephone number(s) of designated company liaison officer;


(k)     Company’s 3-year Financial Statements and 3-year audited accounts for entities that have existed longer than five (5) years OR Company’s duly signed Annual Financial Reports for entities that have existed less than five (5) years but for over a year.


(l)      Evidence of Registration of Business Premises with Ekiti State Ministry of Investment, Trade and Industries (MITI).Ado-Ekiti;


(m)    Note that registration with BPP will attract a flat non-refundable registration fee of Twenty Thousand naira (N20, 000.00) for every entity excluding Micro, Medium and Small-Scale Enterprises based within Ekiti State who will be registered free in their first year of registration. However, appropriate additional classification and categorisation fees may apply for every entity.


(n)     Contractors are to note that the additional schedule of fees (registration and renewal) for classification and categorisation are as stated on our web portal at https://bpp.ekitistate.gov.ng/portal


Please refer to our web portal for information regarding the specific requirements for registration of Micro, Small and Medium Enterprises (MSMEs) and Limited Liability Entities (LLCs).


(4.0)  GENERAL INFORMATION


Application can be filed directly online or application forms downloaded from the Bureau’s website at https://bpp.ekitistate.gov.ng while hard copies can also be obtained from BPP’s Front Desk at Bureau of Public Procurement (BPP), Governor’s Office, Oke-Bareke G.R.A., Ado- Ekiti (360261), Ekiti State or at Ekiti State State Liaison Offices in Abuja and Lagos.


Completed application forms may be submitted ONLY online from anywhere or at the Bureau’s Internet Cafe located within the premises of our Ado-Ekiti office, between 10:00 AM and 2:00 PM daily. The documents must be accompanied with evidence of payment of the non-rcfundable registration fee of Twenty Thousand naira only (N20, 000.00).

Entities with valid and unexpired registration with the Bureau arc not expected to re-register, however they may activate their online accounts with the Bureau by uploading all the documents listed in paragraph 2 above via the web portal. In consonance with Sections 12(1) and 13(2) of Ekiti State Public Procurement Law No 4 of2020 and with a view to aligning with the State’s financial calendar, prospective entities are to note that starting from 1 May 2020. all fresh registrations or renewals will now expire on 31 December of each fiscal year.


(5.0)  VERIFICATION OF INFORMATION AND DATA SUPPLY


Prospective entities are to note that, where possible/required the registration process will involve verification of information supplied in their applications and physical demonstration of special skills, trade tools or equipment/machinery listed in their submissions.


Entities may also be requested to provide additional information or give further clarifications on submissions made in their applications. Misrepresentation of facts, gross misstatements or false declarations, if discovered at any time, even after registration, shall form the basis for disqualification or non-registration or withdrawal of registration.


(6.0)  PLEASE NOTE THAT


(a)      Entities should clearly specify their area(s) of interest(s) in works, goods and services;


(b)     ALL MDAs or public institutions of the Government of Ekiti State (arms and tiers of Government) are legally and duty bound TO NOT DO business or enter contractual agreement with any entity not duly registered with the Bureau while any entity NOT REGISTERED with the Bureau will not be allowed to participate in the procurement or disposal of assets of the Government of Ekiti State and all her organisations (including Educational Institutions, Local Government Area Councils and Donor-support projects) effective immediately;


(c)      The Government of Ekiti State or any of its institutions is not Legally Bound to enter into any contractual agreement or negotiations with any party based on this advertisement.
